The conditions for using rayQuiz

Welcome to rayQuiz! By accessing or using our services, you agree to comply with the terms and conditions below. Please read them carefully before you begin.

1. Acceptance of Terms

By registering an account or using any rayQuiz service, you confirm that:

  • You are at least 16 years old, or you have the consent of a parent or legal guardian.
  • You have full legal capacity to enter into a binding contract.
  • You agree to comply with all of the terms set out in this document and our Privacy Policy.

2. Description of Service

rayQuiz is an online education platform that provides:

  • Create and take quizzes: Multiple question types (multiple choice, fill-in-the-blank, matching, and more).
  • Online exam rooms: Run real-time proctored exams.
  • AI assistance: Automatically generate quizzes from documents or topics.
  • Marketplace: Buy and sell quizzes between teachers.
  • Classroom management: Track student progress (for teachers).
  • We continually develop our services and reserve the right to change, update, or discontinue any feature without prior notice.

3. User Accounts

3.1 Account Registration

  • You must provide accurate and up-to-date information when registering.
  • Each person may hold only one account (unless authorized in writing).
  • You are responsible for keeping your login credentials secure.

3.2 Account Security

  • Do not share your password or allow others to access your account.
  • Notify us immediately if you detect any unauthorized access.
  • You are fully responsible for all activity that occurs under your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account if:

  • You breach any of the terms in this document.
  • You provide false or misleading information.
  • You engage in fraudulent, abusive, or illegal activity.
  • Your account is inactive for an extended period (over 24 months).

4. Rules of Use

4.1 Permitted Conduct

  • Use the service for legitimate educational and learning purposes.
  • Create original content or content you have the rights to use.
  • Interact respectfully with other users.

4.2 Prohibited Conduct

You must never:

  • Cheat: Use automated software, share answers during an exam, or engage in any form of cheating.
  • Post violating content: Upload pornographic, violent, discriminatory, or otherwise illegal content.
  • Infringe: Violate intellectual property rights, privacy rights, or the rights of others.
  • Abuse the system: Attack, interfere with, or disrupt the operation of the platform.
  • Harvest data: Scrape, crawl, or collect information about other users without permission.
  • Unauthorized commercialization: Resell the service or content without an agreement.

5. User Content

5.1 Ownership

You retain ownership of the content you create (quizzes, questions, etc.). However, by uploading content to rayQuiz, you grant us:

  • The right to use, store, display, and distribute your content to operate the service.
  • The right to use your content (in anonymized form) to improve and develop the platform.
  • The right to remove or edit content that violates the terms.

5.2 Responsibility for Content

  • You are solely responsible for the content you create and upload.
  • rayQuiz is not responsible for the accuracy or quality of user-generated content.
  • We reserve the right (but not the obligation) to review and remove violating content.

6. Payments and Refunds

6.1 Paid Plans

  • Some features require a paid subscription (Teacher Pro, Business, etc.).
  • Prices are displayed in VND and include applicable taxes.
  • Payments are processed via VPBank QR.

6.2 eWallet

  • Wallet balances can only be used within the rayQuiz platform.
  • Wallet balances do not expire but cannot be transferred or withdrawn.
  • Marketplace quiz purchases are made through the wallet.

6.3 Refund Policy

  • Subscriptions: Refundable within 7 days if no paid features have been used. After 7 days, no refunds.
  • Quiz purchases: Non-refundable once the content has been accessed.
  • Wallet top-ups: Non-refundable for balances already added to the wallet.
  • Technical issues: If a fault on our side causes you loss, we will consider an appropriate refund or compensation.

7. Intellectual Property

  • rayQuiz, its logo, interface, and source code are our property and are protected by intellectual property law.
  • You may not copy, modify, distribute, or create derivative works from the platform without written permission.
  • Using the service does not grant you any intellectual property rights in the platform.

8. Limitation of Liability

Important: Please read this section carefully.

To the extent permitted by law:

  • rayQuiz provides the service "as is" and "as available".
  • We do not guarantee the service will be error-free, uninterrupted, or meet all of your requirements.
  • We are not liable for any indirect, special, incidental, or consequential damages.
  • Our maximum liability shall not exceed the amount you have paid us in the preceding 12 months.
  • We are not responsible for user-generated content or the conduct of other users.

9. Indemnification

You agree to indemnify and hold harmless rayQuiz, its development team, and partners from any claims, damages, or costs (including reasonable legal fees) arising from:

  • Your breach of these terms.
  • Content you upload that infringes the rights of a third party.
  • Your unlawful use of the service.

10. Dispute Resolution

  • All disputes will first be resolved through good-faith negotiation.
  • If negotiation fails, the dispute will be brought before an arbitration body or court of competent jurisdiction in Vietnam.
  • These terms are governed by the laws of Vietnam.

11. Changes to the Terms

We may amend these terms at any time. Significant changes will be communicated via:

Continuing to use the service after changes take effect means you accept the updated terms.

  • Email to your registered email address.
  • A prominent notice on the website.

12. Miscellaneous

  • Entire agreement: These terms and our Privacy Policy constitute the entire agreement between you and rayQuiz.
  • Waiver: Our failure to enforce a term does not constitute a waiver of the right to enforce it later.
  • Severability: If any term is held invalid, the remaining terms remain in full effect.
  • Assignment: You may not assign your rights or obligations under these terms without our consent.
